Federal Court Orders Freedom of Abrego Garcia from Immigration Custody

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The case stems from a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to answer human smuggling allegations, he was held in federal custody.

In her order, the judge pointed out that the authorities does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The court challenge center on disputed assertions. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this claim.
